Who Is Petitioner & Beneficiary?

The individual who submits the I-130 form acts as the petitioner for the beneficiary (relative). The evaluation of the submitted form is conducted by an adjudicator. The beneficiary has the opportunity to acquire an Immediate Relative visa or a family-based preference visa to the U.S. Subsequently, after obtaining a visa from the USCIS, the beneficiary can apply for a Green card.

Who May File Form I-130?

If the petitioner is a U.S. resident, they can file the I-130 form for various relationships, including spouses, unmarried children (21 years old), married sons and daughters (without age restrictions), fathers, mothers, brothers, and sisters (petitioner should be above 20 years old). Lawful permanent residents can file the I-130 form for spouses and unmarried children (sons & daughters).

Who May Not File Form I-130?

Certain individuals cannot file I-130 forms, including adoptive parents, children, stepfather or mother, spouses who have lived outside the U.S. for more than 2 years after marriage, grandparents, nephews, grandchildren, nieces, aunts, uncles, cousins, or parents-in-law.
